Уважаемый г-н Норват,

Мы получили Ваше электронное письмо от 8.06.2016 №. SE/2011/054174, касающееся нарушений нами контрактных обязательств. Однако мы не получили Ваше официальное письмо заказной почтой, поскольку так должна осуществляться вся официальная переписка согласно пункту 19.7. Поэтому мы направляем Вам наш предварительный ответ по электронной почте. Официальный ответ будет направлен Вам после того, как мы получим Ваше письмо по почте в соответствие с пунктом 19.7.
Настоящим письмом мы хотели бы разъяснить свою позицию в отношении противоречий по исполнению Контракта. Ниже мы даем разъяснения на вопросы, поднятые в Вашем письме:

1. Мы не смогли представить вам все необходимые документы в связи с тем, что Заказчик не согласовал основные проектные документы для поставки, что стало соответственно причиной подобных задержек. Документы для монтажа не могут быть разработаны без окончательного согласования Заказчиком документов первого этапа. Следовательно, мы так же не можем начать процесс изготовления оборудования. Более того, мы не можем предоставить некоторые документы в связи с тем, что вы нам не предоставили в полном объеме исходные данные согласно Приложения 21.

2. Задержка внесения Подрядчиком изменений в документацию по замечаниям Заказчика произошла по причине того, что замечания содержат дополнительные требования, которые не входят в объем работ по Контракту. Обязательства Подрядчика должны ограничиваться объемом работ, которые четко определены в Контракте, а все дополнительные требования должны регулироваться согласно процедуре внесения изменений и подписанием дополнения к Контракту.


В связи с этим, с целью принятия взаимоприемлемого решения мы предлагаем организовать двустороннюю встречу на следующей неделе.
Принимая во внимание взаимные обязательства, мы надеемся урегулировать все нерешенные вопросы и принять скоординированные решения, нацеленные на благополучное исполнение Контракта.

However, we have not received your approval letter certified mail, as well as all official correspondence should be carried out according to paragraph 12.2. Therefore, we send you our preliminary reply via email. The official response will be sent to you after we receive your letter by mail in accordance with paragraph 12.2.Herewith we would like to explain its position on the controversy for the execution of the contract. Below we give an explanation to the questions raised in your letter: 1. We are not able to provide you with all necessary documents in connection with the fact that the employer has not agreed on key project documents for delivery that was the cause of these delays, respectively. Documents for installation could not be developed without final agreement the employer documents the first phase. Therefore, we cannot begin the process of manufacturing equipment. Moreover, we cannot provide some documents in connection with the fact that we do not provide full source data in accordance with Annex 21.2. the delay making Contractor changes in Customer comments documentation occurred because the comments contain additional requirements that do not fall within the scope of the work under the contract. Obligations of a contractor should be limited to the amount of work, which are clearly defined in the contract, and any additional requirements should be settled in accordance with the procedure for changes and supplements to the contract signing. In this regard, with a view to adopting mutually acceptable solution we offer to arrange a bilateral meeting next week. Taking into account the mutual commitments, we hope to resolve all outstanding issues and adoption of coordinated decisions on the successful performance of the contract.

We have received your e-mail from 8.06.2016 №. SE / 2011/054 174, relating to violations of our contractual obligations. However, we have not received your official letter by registered mail, as well all official correspondence in accordance with paragraph 19.7 should be carried out. Therefore, we are sending you our preliminary answer by e-mail. The official response will be sent to you after we receive your letter by mail in accordance with paragraph 19.7.
With this letter we would like to clarify its position on the conflict for the implementation of the Contract. Below we give an explanation on the issues raised in your letter:

1. We were unable to provide you with all the necessary documents in connection with the fact that the customer has not agreed on the basic design documents for delivery, which was the reason for such delays, respectively. Documents for the installation can not be developed without a finalization of the first phase of the customer documents. Therefore, we also can not begin the process of manufacturing equipment. Moreover, we can not provide certain documents in connection with the fact that you did not provide us the full original data in accordance with Annex 21.

2. Delay introduction of the Contractor changes in documentation Customer comments occurred due to the fact that the notes contain additional requirements that are not included in the scope of work under the Contract. Contractor's obligations shall be limited to the scope of work, which are clearly defined in the Contract, and any additional requirements should be adjusted according to the procedure of making changes and signing of a supplement to the contract.


In this regard, with a view to a mutually acceptable solution, we propose to organize a bilateral meeting next week.
Taking into consideration of the mutual commitments, we hope to resolve all outstanding issues and take coordinated decisions aimed at the safe execution of the Contract.
