С учетом особенностей отрицательной целевой функции аномальных правоотношений можно выделить административные правонарушения: а) принципов, форм и методов советского государственного управления; б) компетенции исполнительно-распорядительных органов, общественных и самодеятельных организаций, которым предоставлены государственно-властные полномочия; в) субъективных прав и обязанностей граждан.
Для всех видов правонарушений характерно столкновение двух начал: правомерной и неправомерной воли. Воля является основным двигателем возникновения, изменения и прекращения комплекса противоправных связей. Но она должна быть проявлена в конкретном поведении субъектов административных правоотношений, ибо сама по себе, воплощенная только в мысли или желании, не имеет никакого юридического значения.
Административное право как управленческая воля является концентрированным выражением определенных экономически и исторически обусловленных организационных тенденций развития государства. Преобразуясь в повседневную деятельность исполнительно-распорядительных органов, компетентных общественных организаций, отдельных граждан, они обретают конкретное социальное выражение. В системе правоотношений, выражающих административное правонарушение, взаимодействуют такие волевые проявления, которые основаны на потребностях, интересе, имеют мыслительное и психологическое содержание. Это наводит на мысль о непосредственной связи аномальных ситуаций с уровнем социалистического правосознания участников административных правоотношений.
Индивидуальное правосознание имеет сложную структуру. Оно складывается из системы взглядов и привычек, психологических свойств человека, информированности его о нормах права. Оно отражает условия человеческой жизни и всегда связано с происходящими в обществе процессами. В этом смысле индивидуальное правосознание неразрывно связано и с общественным правосознанием. На него оказывают влияние общий уровень представлений об административном праве, законности в сфере государственного управления и взгляды той социальной микрогруппы, участником которой является гражданин.
В формировании индивидуального правосознания большую роль играют служащие органов управления, которые осуществляют исполнительно-распорядительные функции и принимают индивидуально-конкретные решения в отношении граждан. Тем самым их правосознание является непосредственным фактором формирования правосознания других лиц.
Административные правонарушения как система общественных связей возникают и развиваются не сами по себе, а в тесной связи с другими социальными отношениями. Они отражают состояние последних, их динамику и структуру. Исходя из сложившегося в литературе группирования административных отношений по сферам управления можно выделить три разновидности правонарушений. Одни из них возникают в системе управления народным хозяйством, другие -- в процессе руководства социально-культурными учреждениями, третьи -- в ходе реализации административно-политических функций исполнительно-распорядительного аппарата. Содержание каждой из них индивидуализируется субъектами, объектом, требованиями нормы права.
Административное правонарушение объективизируется в двух формах социального проявления: издании акта государственного управления или совершении проступка, мешающих осуществлению управленческой воли государства. Оба эти юридических факта являются основанием возникновения деликтных правоотношений. В процессе их развития могут наступить два вида последствий: моральная или юридическая ответственность.
За административные правонарушения, совершенные гражданами или должностными лицами, наступает административная ответственность, связанная с возможностью применения наказания.
