ООО «ОМЗ-Спецсталь» изучила договор займа № PSZ 080210-00 от 08.02.2010 и так как, согласно п.6.2, русский текст договора имеет приоритет над английским, и в русском тексте в п.5 указано, что споры подлежат рассмотрению в Арбитражном суде при Торгово-промышленной Палате Чешской Республики, а Pilsen Estates s.r.o. обратился с заявлением в Арбитражный суд при Экономической Палате Чешской Республики и Аграрной Палате Чешской Республики,
ООО «ОМЗ-Спецсталь» считает, что условие арбитражной оговорки не выполнено.
Соответственно Арбитражный суд при Экономической Палате Чешской Республики и Аграрной Палате Чешской Республики не компетентен рассматривать данный спор.
