По своей сущности наказание является наиболее строгой мерой государственного принуждения, поэтому в отличие от иных мер наказание применяется к лицу, признанному виновным в совершении преступления по приговору суда.
По своему содержанию наказание заключается в лишении и ограничении прав и свобод осужденного как человека и гражданина государства.
Любое разумное действие человека обязательно должно преследовать определенную цель, в противном случае его можно назвать бессмысленным.Цели уголовного наказания — те конечные фактические результаты, которых стремится достичь государство, устанавливая наказание в уголовном законе, определяя меру наказания лицу, виновному в совершении преступления, и применяя эту меру.
Основными целями наказания являются восстаноааение социальной справедливости, а также исправление осужденного и предупреждение совершения новых преступлений осужденным и иными лицами.

Цель исправления осужденного заключается в изменении посредством применения уголовного наказания негативных свойств личности виновного, приведших его к совершению преступления, чтобы сделать его безопасным, правопослушным членом общества. Эта цель реализуется посредством оказания на осужденного необходимого, вызываемого характером и степенью его социально-нравственной «испорченности», исправительно-воспитательного воздействия при назначении наказания и в процессе его исполнения.
Цель предупреждения совершения новых преступлений состоит в том, чтобы посредством применения уголовного наказания в отношении лица, совершившего преступление, добиться, чтобы ни само это лицо, испытавшее воздействие наказания, ни какие-либо другие лица, которым известен факт применения наказания, не совершали преступлений.
