Развитие международного права в области охраны окружающей среды происходит в основном договорным путем. Международные договоры об охране окружающей среды необходимы для эффективной согласованной природоохранительной деятельности и ее правовой регламентации. На сегодняшний момент имеется более 500 международных договоров об охране окружающей среды. Международные договоры об охран" окружающей среды могут быть: многосторонними, региональными универсально-глобальными,договорами, которые регулируют общи вопросы защиты окружающей среды либо отдельных каких-то объектов окружающей среды.

Анализ договорной практики международных договоров об охране окружающей среды позволяет сделать вывод, что наиболее активно развиваются договорные отношения на двусторонней и региональной основе, направленные на правовую регламентацию отдельных природных объек тов в определенных районах.
Международные договоры об охране окружающей среды, кроме того, разделяются по предмету регулирования на предотвращение загрязнения и установление режима использования возобновляемых и невозобновляемых природных ресурсов. При этом большинство договоров приходится на региональные акты.
В отличие от односторонних, двусторонние договоры чаще всего регламентируют совместное использование международных пресноводных бассейнов, морских акваторий, флоры и фауны и т. д.
На региональном уровне, как свидетельствует международная практика, наиболее успешно достигается конкретное решение экологических проблем.
