Большинство современных международных конференций завершается принятием решений. Положения, касающиеся детальной регламентации принятия решений, включены в правила процедуры большинства современных конференций. Механизм принятия решений зависит от цели созыва конференции, соответствующих положений ее правил процедуры и от установившейся обычной практики.
Конкретные процедуры принятия решений можно сгруппировать в три системы: традиционную, консенсуальную и комбинированную.
Под традиционной понимается такая система принятия решений, которая в качестве основного метода выявления воли государств-участников предусматривает проведение голосования.
Для консенсуальной системы характерен путь согласования позиций государств-участников без проведения голосования и при отсутствии формальных возражений против принятия решения в целом. Это значит, что разрабатываются такие решения, с которыми могут согласиться все участники конференции. Применение консенсуса при решении важнейших вопросов в целом имеет положительное значение и призвано служить тому, чтобы не допустить навязывания государствам чужой воли с помощью механического большинства. Одновременно правило консенсуса содержит в себе потенциальные возможности злоупотребления им со стороны тех, кто стремится оттягивать принятие договоренностей, чинить препятствия достижению согласия.
Комбинированная система принятия решений представляет собой сочетание консенсуальной и традиционной. Она исходит из желательности достижения согласованного мнения всех государств-участников без проведения голосования до тех пор, пока не будут исчерпаны все усилия по достижению такого согласованного мнения.
Традиционная система принятия решений основывается на опыте конференций конца xix - начала xx в., и особенно на опыте лиги наций. Этот процесс начинается с обсуждения одного или нескольких текстов (проектов резолюций, проектов статей и т.п.). Этот процесс обычно состоит из трех этапов: подготовка, обсуждение и принятие текста (проекта резолюции, проекта статей и т.п.). Что касается комбинированной системы принятия решений, то она пока использовалась лишь на iii конференции оон по морскому праву.
