Актуальность. В настоящее время рынок перестрахования в России переживает тяжелый период своего становления. В работе отмечены актуальные проблемы отсутствия в законодательстве ключевых понятий, которые необходимы для нормального функционирования системы перестрахования.
Авиация – важнейшая отрасль экономики страны, а качественное правовое регулирование – необходимое условие ее существования. Рассмотрение проблемы перестрахования ответственности авиаперевозчика актуально в связи с возрастающим из года в год количеством авиакатастроф, имеющих крайне негативные последствия как для пассажиров, так и для самих перевозчиков.
