Правовая система любой страны зависит от ее истории, политической структуры и общественных ценностей. В мире есть немного стран, которым удалось сохранить политическую преемственность. Одной из таких стран является Великобритания, где действуют законы и правовые принципы, которые зародились много столетий тому назад.
Хотя многие имеют свои собственные системы права, можно сказать, что в мире существуют две основные традиции права. Одна из них основана на римском праве и также известна как континентальная система. Она развивалась в Европе, Латинской Америке и многих странах Азии и Африки, которые находились под сильным европейским влиянием.
В чем же отличие системы прецедентного права от континентального права? Общее право, особенно в Англии, развивалось постепенно в ходе истории, а не в результате попыток правительства определить и кодифицировать все правоотношения.
