Что же такое «право» и каковы его основные признаки? Будучи неразрывно связанным с государством, право в реальной жизни выступает в виде общеобязательных правил поведения (норм). Они непосредственно издаются либо санкционируются (утверждаются) государством. За нарушение их к нарушителю применяются различные меры государственного воздействия. Нормы издаются в форме различных нормативно-правовых актов (законов, постановлений, указов, инструкций и т. п.), которые принято называть «формальная закрепленность норм». Вся совокупность правовых норм объединяется в единую систему прав, присущую определенному государству, в силу чего право выступает как система норм. Важной особенностью норм права является то, что они рассчитаны не на однократное, а на многократное применение. Следует отметить, что ни отдельные нормы, ни право в целом в социальном плане никогда не бывают абстрактными. Право всегда выражает и закрепляет прежде всего волю и интересы властвующих кругов и классов. Нет права «вообще». Оно всегда конкретно и реально. В этом выражается сущность права. В чем состоит назначение и каковы функции права в жизни общества? В чем конкретно выражается его роль? При ответе на эти вопросы важно иметь в виду неразрывную связь государства и права.
