Случаи проведения любых форм эвтаназии в Украине считаются противоправными и квалифицируются как убийство, — объясняет адвокат Екатерина Тарасова, — поэтому и рассматриваются в суде по соответствующим статьям Уголовного кодекса. Ведь одним из важнейших прав, обеспечивающих само физическое существование человека как биологического существа, согласно ст. 27 Конституции, является право на жизнь. А ст. 3 Основного Закона закрепляет положение, по которому человек, его неприкосновенность и безопасность признаются в Украине высшей социальной ценностью. Право на жизнь гарантирует неприкосновенность физического существования человека. А на удовлетворение просьбы о прекращении его жизни наложен запрет в Гражданском кодексе Украины и ряде статей медицинского законодательства. Однако мнение украинского общества по этому вопросу не так категорично, как действующее законодательство. Из результатов опроса, проведенного в октябре 2011 г. институтом Горшенина среди 1 тыс. респондентов в различных регионах Украины, удалось установить, что против эвтаназии выступают лишь 37,1% опрошенных. А поддерживают ее, в той или иной форме или ситуации, около 62%. Для сравнения, в 2007 г. количество людей, которые были категорически против добровольной смерти для неизлечимо больных, составляла 57%. Как видим, с каждым годом все больше людей начинает поддерживать легализацию эвтаназии. Но до этого в ближайшее время, скорее всего, дело не дойдет. Ведь в Украине большое влияние на общественное мнение оказывает церковь, главный постулат которой — никто и ничто не может дать разрешение на убийство невинного человеческого существа. Согласно христианскому учению, страдания, особенно во время последнего момента жизни, имеют особое место в спасительно Божьем плане. Они являются свидетельством участия в Христовых страданиях и в Его спасительной жертве. При этом церковь не запрещает умеренное употребление обезболивающих средств, облегчающих боль, но не убивающих неизлечимо больного человека. Считается, что таким образом христиане добровольно принимают хотя бы часть страданий в сопоставлении со страдающим и распятым Христом. Существуют и другие причины, по которым в Украине невозможно узаконить эвтаназию. Среди них — увеличение риска давления на инвалидов, престарелых и неизлечимо больных людей со стороны родственников, желающих прибрать к рукам их имущество или наследство. — В наших условиях жизни сложно будет установить добровольность принятия решения о смерти. И даже в том случае, когда согласие пациента — очевидно, всегда существует вероятность того, что он может пересмотреть свое решение. Но начатая процедура лишения жизни уже вызовет необратимые изменения в его организме, — утверждает адвокат, кандидат юридических наук Виктория Тисногуз. — К тому же, процедура эвтаназии может облегчить совершение преступлений путем применения физического или психологического давления на пациента, подкупа медицинского персонала, злоупотребления должностным положением, мошенничества и т.п. Могут возникнуть проблемы с правильностью постановки диагноза и прогнозом дальнейшего развития заболевания, получением согласия пациента, находящегося в бессознательном состоянии, установлением и доказыванием добровольного ухода из жизни, медико-этическими моментами и даже торговлей человеческими органами. В связи с осознанием масштаба возникших в случае легализации эвтаназии проблем, в свое время в Верховной Раде был отклонен соответствующий проект закона. Новых законодательных инициатив по этому вопросу пока не поступало.
