the common law dominates the national legal systems of great britain (in scotland), canada, the united states, jamaica, australia, etc. d. the mother of this legal family was england. in the basis of this legal system is the principle to stand by the things decided (from the latin, stare decisis stand решенном), meaning that the judgement of the court of the dominant power is precedent. the main source of law in anglo saxon legal system is a custom (by judicial precedent). the law is regarded as a kind of contract. thus, in contrast to the romano german system, judicial decisions play an important role in the formation of the right, whereas the romano german system gives the courts function of interpretation and application of law.
