4. Ответственность Сторон.
4.1. В случае нарушения одной Сторон каких-либо условий настоящего договора, Стороны вправе отказаться от заключения договора найма жилого помещения.
4.2. В случае, если жилое помещение не соответствует требованиям согласованного дизайн-проекта, о чем Сторона -2 уведомила Сторону-1 в письменной форме, при условии, что между Стороной-1 и Стороной-2 не было достигнуто соглашение о сроках устранения обнаруженного несоответствия в течение 10-дневного срока, либо такое соглашение было достигнуто, но не было выполнено Стороной -1 в оговоренный срок, Сторона-2 вправе отказаться от заключения договора найма жилого помещения, а Сторона-1 обязана возместить Стороне-2 полученную предоплату по п. 2.3.
