По своему содержанию наказание заключается в лишении и ограничении прав и свобод осужденного как человека и гражданина государства.
Любое разумное действие человека обязательно должно преследовать определенную цель, в противном случае его можно назвать бессмысленным.
Основными целями наказания являются восстаноааение социальной справедливости, а также исправление осужденного и предупреждение совершения новых преступлений осужденным и иными лицами.
Восстановление социальной справедливости осуществляется применительно как к обществу в целом, так и к потерпевшему в частности: государство частично возмещает причиненный ущерб за счет штрафа, конфискации имущества, исправительных работ и др.Применительно к потерпевшему социальная справедливость восстанавливается путем защиты законных интересов и прав, нарушенных преступлением.
