4.13. В Акте об установленном расхождении по количеству и качеству должна содержаться информация, указанная в п.4.6 настоящего Контракта, а также иные сведения, если Покупатель и/или иные лица, участвующие в приёмке, будут считать такие сведения важными.
4.14. Дистрибьютору предоставляется трое суток с момента получения Товаров на отправку Поставщику Акта об установленном расхождении по количеству и качеству (если таковой составляется).


СТАТЬЯ 5
ПРЕТЕНЗИИ ПО КОЛИЧЕСТВУ И КАЧЕСТВУ

5.1. Претензии по количеству и/или качеству Товара направляются Покупателем Поставщику или одновременно с Актом об установленном расхождении по количеству и качеству, или позже, если Покупатель для составления претензии решит осуществить изготовление/получения дополнительных доказательств (акты и заключения специализированных организация, фото, видео и т.п.).
5.2. Претензии, указанные в п.5.1 настоящего Контракта, должны быть направлены Поставщику в письменной форме, в течение 14 (Четырнадцать) дней со дня окончания срока для основной приёмки (п.4.9).
5.3. В дополнение к вышесказанному в п.5.2, претензии по качеству Товара принимаются Поставщиком в течение всего срока годности конкретного Товара, если ненадлежащее качество будет в этот срок обнаружено Покупателем и/или третьими лицами, купившими у Покупателя Товар.

5.4. Все претензии Дистрибьютора, связанные с недостачей, пересортицей, возвратом или обменом некачественных Товаров, Товаров с нарушенной упаковкой или ненадлежащей маркировкой должны быть удовлетворены Поставщиком (в случае их признания) при очередной поставке Товаров, но не позднее, чем через 30 (Тридцать) дней с даты получения Поставщиком соответствующей претензии (если Покупатель письменно не согласится на более длительный срок).

СТАТЬЯ 6
КАЧЕСТВО ТОВАРА, УПАКОВКА И МАРКИРОВКА
6.1. Поставщик гарантирует Дистрибьютору, что качество поставляемых Товаров будет соответствовать требованиям государственных стандартов РФ, технических условий изготовителя соответствующих Товаров, а также всем иным обязательным требованиям, предусмотренным действующим законодательством Российской Федерации.
6.2. Соответствие качества товара должно быть подтверждено сертификатом качества, выданным Государственной компетентной организацией страны происхождения, в котором, как минимум, указывается полное наименование Товара, фактические показатели качества Товара, его упаковка и маркировка.
6.3. Сертификат качества должен быть в оригинале и оформлен как на языке страны происхождения, так и на русском языке.
6.4. Поставщик гарантирует качество поставленного Товара в течение срока годности Товара, начиная со дня, когда Товар получен Покупателем в месте назначения.
6.5. Весь Товар, поставляемый по настоящему Контракту, должен быть произведён не более чем за 15 (Пятнадцать) дней до момента отправки Покупателю. При этом моментом отправки считается дата изготовления транспортного документа (CMR).
6.6. В случае, если Поставщик не имеет возможности обеспечить указанную в п.6.5 настоящего Контракта давность производства Товара/части Товара, он должен письменно известить Покупателя не менее, чем за ______ дней до момента отправки Товара. Поставка такого Товара может быть осуществлена Поставщиком только в случае получения письменного разрешения Покупателя. В ином случае Покупатель, получивший такой Товар, имеет право считать такую поставку ненадлежащей, а Товар/часть Товара – некачественным.
6.7. Упаковка и тара должны иметь надлежащую маркировку, соответствовать установленным ГОСТам и ТУ, и обеспечивать сохранность Товара при условии надлежащего c ним обращения.
