Очередное слушанье по «Детям-404»: является ли Лена Климова заинтересованным лицом в деле о блокировке группы?

Сегодня состоялось очередное судебное заседание по делу о группе «Дети-404». Санкт-Петербургский городской суд принял решение отложить рассмотрение дела до 1 октября 2015 года, сославшись на то, что до рассмотрения дела по существу (вопрос о блокировке группы) необходимо выяснить, является ли журналистка Елена Климова заинтересованным лицом в деле.

20 августа в Санкт-Петербургском городском суде состоялось очередное слушание по делу о внесении группы «Дети-404» в список запрещенных на территории РФ Интернет-ресурсов. На это раз суд рассматривал только процессуальные вопросы, а точнее – один вопрос. Может ли Елена Климова вступить в дело о блокировке группы в социальной сети «Вконтакте» в качестве третьего лица. Несмотря на то, что адвокат журналистки Дмитрий Бартенев предоставил коллегии судей информацию о параллельных делах с участием Елены Климовой, в которых суды Нижнего Тагила четко указывали на связь журналистки с группой «Дети-404», этого оказалось недостаточно. Судьи потребовали запросить дополнительные материалы о статусе Елены Климовой как администратора группы «Дети-404» у ООО «ВКонтакте».

Напомним, в марте 2015 года в сети интернет было распространено письмо Генеральной прокуратуры России руководителю проекта «МедиаГвардия» Илье Подсеваткину. В этом письме сообщалось о том, что по его заявлению была проведена проверка материалов группы «Дети-404» и назначено рассмотрение искового заявления. Только 29 апреля адвокату Елены Климовой удалось получить официальное подтверждение того, что 25 марта 2015 года Октябрьский суд Санкт-Петербурга рассмотрел дело и принял решение о блокировке группы «Дети-404» в социальной сети «ВКонтакте». 30 апреля адвокат Дмитрий Бартненев подал апелляционную жалобу с просьбой отменить решение Октябрьского суда и направить дело на новое рассмотрение. Кроме того, Дмитрий Бартенев подал заявление о вступлении Елены Климовой в дело в качестве третьего лица. В апелляционной жалобе, поданной адвокатом, отмечается, что Елена Климова является администратором группы «Дети-404» в социальной сети «ВКонтакте», и принятое судом решение напрямую затрагивает ее право на свободу распространения информации.
